Todd Muchnick and Aaron Haber obtained a $700,000 personal injury case settlement for a woman whose vehicle was struck in a tractor-trailer accident operated by a major interstate trucking company. The truck accident occurred on Interstate 44 in Crawford County, Missouri. The tractor-trailer was westbound on the highway when the driver fell asleep, crossed the median into oncoming traffic, and struck our client’s vehicle, knocking her off the highway. She had to be removed from her vehicle by witnesses to the accident. She suffered fractures to her collarbone and cervical spine. During her recovery she began to have emotional problems that were later diagnosed as post-traumatic stress disorder (PTSD). A lawsuit was filed on behalf of the injured woman and her husband. A thorough investigation revealed that the driver and the carrier were in violation of the Federal Motor Carrier Safety Regulations at the time of the accident. These violations included driving over the allowed hours of service and failures of the trucking company to monitor its drivers’ actions. After mediation, and prior to trial, the parties settled the personal injury case.
