April 2018 - $1,000,000 Settlement- Tractor Trailer Crash - Springfield, Missouri

Josh Margolis helped a woman who was severely injured obtain a policy-limits, One Million Dollar settlement for a tractor-trailer accident that forever changed her life.  The truck driver made an improper turn and the trucking company blamed the client for speeding and not paying attention.  Through use of experts using physical and forensic evidence, we were able to defeat the defendants' arguments.  We also showed the company violated its own policies and procedures in failing to hire and train a qualified driver.

The client's injury was heavily contested as she did not suffer broken bones or any other visible injuries.  However, she progressively lost function in her arm and hand over the following years, resulting in numerous medical procedures including surgeries and injections.  She was ultimately diagnosed with Complex Regional Pain Syndrome (CRPS).  This medical disorder is controversial and is often associated with people who have psychiatric issues.  The defendants aggressively defended the case by hiring multiple doctors who opined the client was faking and exaggerating her condition.

The case settled shortly before trial after four years of litigation.  Despite the insurance company's initial position that it would not pay a substantial amount of money to settle the case, it ultimately offered the full one million dollar policy limit of the trucking company insurance policy. The client was extremely grateful for the result, especially since a number of other law firms had turned down her case.
